휴스턴 시민단체인 우리훈또스(대표 신현자)가 텍사스 시민사회에서 풀뿌리 민주주의의 표본이 되고 있다. 지난 22일(화) 우리훈또스는 온라인으로 입법과정에 참여해온 내용과 향후 계획에 대해 발표했다.
60여명이 모인 온라인 설명회에서 우리훈또스는 ‘언어접근법’에 대해 강조했다. 우리훈또스는 그동안 영어로 의사소통이 힘든 이민자들을 위한 언어접근성 향상을 법제화 하기 위해 노력해왔다.
이날 설명회에 참석한 휴스턴 한인원로인 한영길 씨는 “40년동안 미국에서 살았지만 영어를 잘 못해서 불편이 많다. 특히 대장암 수술 후 영어를 못해 힘들었고 병원측에서 제공하는 통역이 없어 아는 분의 도움을 받아야 했다”면서 영어에 대한 불편을 겪는 사람들을 위한 주정부 차원의 통역서비스 필요성을 강조했다.
한영길 씨는 “우리훈또스와 함께 주의회 청문회에 참석했다. 영어를 못하는 한인들에게 도움이 될 수 있다는 생각에 용기를 냈고 청문회에서 많은 사람들이 증언하는 것을 보니 우리 사회에 정말 필요한 일임을 알게 됐다”고 말했다.
우리훈또스가 입법을 위해 노력하는 법안은 비영어권을 위한 언어서비스 제공 정책으로 두 명의 공화당 의원과 13명의 민주당의원이 공동발의한 HB 5166이다.
HB 5166은 지난 3월 10일 발의된 이후 4월에는 청문회까지 거쳤으나 여전히 하원 위원회에 계류중이다.
우리훈또스가 주최한 이날 설명회에는 HB 5166 법안을 발의한 페니 모랄레스 쇼(Penny Morales Shaw)의원이 직접 참여해 언어접근법에 대해 설명했다.
HB 5166은 ‘언어접근 계획 개발과 관련해 보건 및 복지 서비스 프로그램에 따른 지원을 이용할 수 있도록 한다’는 내용이 골자다.
따라서 주정부 차원의 통역서비스가 법제화되면 통역을 위해 필요한 경비를 지출하지 않아도 된다. 기존에는 사설 통역업체들을 이용하는 경우가 많았지만 주정부가 통역서비스를 제도화 할 경우 누구나 혜택을 받을 수 있게 된다.
한편, 이날 우리훈또스는 2023년 텍사스 주정부가 인권을 무시한 각종 법적 결정들에 대해 싸워나갈 것임을 분명히 했다. 다양성과 포용성에 대한 문제부터 성소수자와 관련한 각종 차별법안, 이민문제 및 해리스카운티가 직면한 투표권 문제 등 주정부의 결정에 대해 지속적인 문제제기에 나설 것으로 보인다.
또한 카운티와 시당국의 예산이 공공안전과 이민사회 정의실현을 위해 사용될 수 있도록 시민정치참여를 활성화하고 커뮤니티 교육과 지역사회와 연대도 강화할 방침이다.

relating to the development of a language access plan to increase | ||
access to assistance under health and human services programs by | ||
certain individuals. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 531, Government Code, is | ||
amended by adding Section 531.0193 to read as follows: | ||
Sec. 531.0193. LANGUAGE ACCESS PLAN. (a) The commission | ||
shall develop a language access plan to increase non-English | ||
speakers’ access to assistance provided under the health and human | ||
services programs the commission administers. The plan must | ||
ensure: | ||
(1) all of the commission’s public written materials, | ||
forms, applications, portal application systems, and external | ||
communications are translated and orally interpreted into any | ||
language spoken by a group in this state with a population of at | ||
least 50,000 of which at least 33 percent have limited English | ||
proficiency, according to the most recent American Community Survey | ||
compiled by the United States Census Bureau, including: | ||
(A) English; | ||
(B) Spanish; | ||
(C) Vietnamese; | ||
(D) Korean; | ||
(E) Arabic; | ||
(F) Mandarin or Cantonese; and | ||
(G) traditional and simplified written Chinese; | ||
(2) the translated materials, forms, applications, | ||
and external communications are available to the public on the | ||
commission’s Internet website; | ||
(3) that groups described by Subdivision (1) are | ||
informed about language access rights and services, including the | ||
availability of the commission’s written translations and oral | ||
interpretations by: | ||
(A) conducting intentional outreach efforts; and | ||
(B) posting translated information and public | ||
announcements in public spaces; | ||
(4) commission employees are provided training on the | ||
language access plan, language access procedures, and expectations | ||
related to the access plan; and | ||
(5) that quality control and accountability measures | ||
are developed to make certain: | ||
(A) all translations and interpretations are | ||
professional and understandable; and | ||
(B) members of the groups described by | ||
Subdivision (1) are able to evaluate the performance of the | ||
commission’s language access services and the effectiveness of the | ||
language access plan. | ||
(b) The commission shall employ at least one language access | ||
officer to oversee the implementation of the language access plan | ||
and ensure language access services are provided in accordance with | ||
the plan. | ||
(c) The commission may use multilingual commission | ||
employees or contract with a third party to translate and prepare or | ||
provide oral interpretations of the commission’s written | ||
materials, forms, applications, portal application systems, and | ||
external communications as required by Subsection (a). | ||
(d) The executive commissioner may adopt rules necessary to | ||
implement this section. | ||
SECTION 2. If before implementing any provision of this Act | ||
a state agency determines that a waiver or authorization from a | ||
federal agency is necessary for implementation of that provision, | ||
the agency affected by the provision shall request the waiver or | ||
authorization and may delay implementing that provision until the | ||
waiver or authorization is granted. | ||
SECTION 3. This Act takes effect September 1, 2023. |
